The Prosecutor General’s Office has begun issuing official notices against a number of defendants wanted by Azerbaijan under Article 467-13.4 of the Criminal Procedure Code

The criminal case under Articles 137.3 (purchase and sale of human organs or tissues) and 308.2 (abuse of power) of the Criminal Code was completed and sent to the Baku Court of Grave Crimes for consideration on August 26, 2013. Since E. Abdullayev evaded the investigation and fled to a foreign country, he was arrested and placed on the wanted list by the Nasimi District Court.

Jumshud Nuriyev, an ex-deputy of the Azerbaijani Parliament, in his interview with the newspaper Olaylar called the former rector of the International University of Azerbaijan whose activities were suspended ,Elshad Abdullayev, by a world-class swindler, propagandist and KGB agent.

An international search operation is currently underway to capture him.

As Bakupost.az reports, according to the specified article of the code, the body conducting the criminal process – the Main Investigation Department of the Prosecutor General’s Office – is obliged, with observance of the presumption of innocence, to transmit the information provided for in Article 54-2.1 of this code on Public Television and Radio (OTR) and publish it on its official website.

Article 54-2 of the Code is called “Summons”. In accordance with the second part of this article, the summons must indicate the name of the body conducting the investigation, the time of the summons, the nature of the charge and other information.

As Vusal Jafarov, a member of the Bar Association, told Telegraf, from now on, proceedings in absentia will be applied to the accused: “Proceedings in absentia are applied in cases where the accused hides from the body conducting the criminal prosecution, or, despite repeated summonses, evades responsibility or hides outside of Azerbaijan. The main purpose of proceedings in absentia is to prevent a person from evading investigation and trial, and not to obstruct the investigation of the criminal case as a whole.”

According to the new chapter on the official issuance of procedural documents, which was added to the Criminal Procedure Code in early 2024, persons who have been declared wanted by a court decision for evading investigation may be subject to proceedings in absentia.

V. Dzhafarov explained the essence of proceedings in absentia as follows: “A person is wanted on charges of fraud, but since he has been hiding abroad for years, it is not possible to bring him to the investigative body. In this case, state bodies try by all means to find him, but if this does not produce results, the law allows the continuation of a criminal case against this person in absentia under certain conditions.”

According to him, if all operational and investigative measures fail to produce results, the investigative body (observing the presumption of innocence) disseminates information about the summons on state television and radio, and posts it on the official website:

“This is the last attempt to ensure that the person either appears in person or is notified that a trial in absentia will be initiated against him.”

Regarding the procedure for proceedings in absentia, the lawyer said: “For example, the director of the company A. M. was brought to criminal responsibility on charges of tax evasion on an especially large scale (Article 213 of the Criminal Code) or fraud (Article 178 of the Criminal Procedure Code). A case was initiated against him, he was sent summonses to his home and office, and he was also notified by telephone.

However, he left the country, went into hiding and ignores all the summonses sent. A search was announced for 3 months, he is wanted by Interpol. If there is no result, the prosecutor’s office sends a petition to the court exercising judicial supervision so that we initiate proceedings in absentia against this person.

The court assesses that all procedural actions have been carried out, a defense attorney has been appointed for this person, and information has been posted on television and official websites.

The court makes a positive decision and allows proceedings in absentia. In this case, the judicial investigation continues without the participation of this person.

” According to Telegraf’s investigation, the relevant courts of Azerbaijan have declared the following persons wanted. They will be held accountable in absentia in accordance with the established procedure.
